Terms of Service

These Terms of Service govern your access to and use of PokéGurus, which is operated by Grizzly Innovations LLC doing business as PokéGurus, including Chase Mode, Chase Odds, the vault, store credit, card search, insights, shipping requests, and related services. Please read these Terms carefully before using the platform.

1. Acceptance of Terms

By accessing or using PokéGurus, you agree to these Terms. If you do not agree, do not use the platform. If you use PokéGurus on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility and Accounts

You must be at least 13 years old to use PokéGurus. If you are under the age of majority in your state or country, you may use PokéGurus only with the involvement and permission of a parent or legal guardian who agrees to these Terms.

You must provide accurate account information and maintain a valid account to access live account features. PokéGurus currently supports Google sign-in for account access. You are responsible for activity under your account, keeping access to your Google account and device secure, and promptly notifying us if you believe your account has been compromised.

We may suspend, restrict, or terminate accounts that are fraudulent, abusive, unlawful, harmful to the platform, or used in violation of these Terms. We may also refuse usernames, profile values, or account details that are misleading, infringing, impersonating, obscene, or otherwise inappropriate.

3. Platform Services

PokéGurus may offer features including:

  • public card search and market data tools;
  • insights, analytics, pricing, sold-comps, and graded population information;
  • Chase Mode, including live mode and simulation mode;
  • Chase Odds backed by configured inventory, odds settings, and platform rules;
  • a vault where eligible items may be held, redeemed, or requested for shipment;
  • store credit and account balance functionality; and
  • administrative and promotional tools.

Features may change, be restricted, or be removed over time. We are not obligated to maintain any specific feature indefinitely.

4. Simulation Mode and Live Mode

PokéGurus may provide simulation experiences that allow users to preview or interact with gameplay without a live purchase or reward. Simulation mode is for entertainment and demonstration purposes only. No store credit is charged in simulation mode, no live inventory is consumed, and no items are added to a vault.

Live mode uses store credit and may create real vault items or other account effects. You are responsible for confirming you are in the intended mode before opening a live pack or using other live paid features.

5. Chase Mode, Chase Odds, Inventory, and Availability

Chase Mode and Chase Odds are governed by the product rules, selection logic, pricing, and inventory settings configured by PokéGurus at the time of use. Odds, eligibility, and pack structures may differ by product type and may change over time.

Chase Mode may be temporarily unavailable, simulation-only, or out of stock when demand exceeds available inventory or while we source replacement inventory.

In rare cases, a card may reveal during a live experience but require delayed fulfillment, manual review, or post-event inventory reconciliation because of inventory timing, duplicate requests, system faults, or integrity checks. We may cancel, delay, reverse, adjust, or correct a game result, vault action, shipment request, account event, or store credit transaction where reasonably necessary to address fraud, abuse, duplicate actions, pricing mistakes, inventory mismatches, technical issues, or platform security concerns.

Provably fair tooling is provided so users can inspect designated gameplay inputs and verify the disclosed result logic for supported experiences. Verification tools do not guarantee uninterrupted service, perfect availability, or that all ancillary operational details are displayed in every replay view.

6. Vault, Redemption, Return Policy, and Store Credit

Eligible cards or items may be placed in your vault. When available for a specific item, you may choose to hold it, request shipment, or redeem it for store credit according to the values and options shown on the platform at that time. Vault entries may reflect internal snapshots, current market values, or operational fallback values depending on the product and data source.

All redemptions, returns, and value-outs on PokéGurus are handled as store credit only unless we explicitly say otherwise in writing. PokéGurus does not offer cash payouts for vault redemptions, account credits, promotional credits, or item returns. Store credit has no cash value, is non-transferable unless we approve otherwise in writing, and may only be used within PokéGurus. We may adjust balances to correct chargebacks, duplicate grants, reversals, pricing mistakes, suspected abuse, or operational errors.

Market values shown on the platform are operational platform values and may differ from third-party listing prices, realized sale prices, or other valuations. We may refuse, reverse, or adjust a redemption or store credit event if we identify pricing errors, fraud, abuse, duplicate claims, technical errors, or inventory issues.

7. Payments and Billing

If you purchase store credit or other paid services, you agree to pay all applicable charges, taxes, fees, and shipping costs. Payment processing may be handled by third-party providers, and your relationship with those providers may also be governed by their separate terms and policies.

PokéGurus currently accepts payments only from customers in the United States and Canada. We may reject, limit, delay, or cancel checkout attempts that do not meet our supported country requirements.

We may place limits on transactions, reject transactions, delay processing, require additional review, or suspend fulfillment to manage fraud, disputes, card testing, abuse, platform integrity, operational risk, or compliance requirements. If a payment is reversed, disputed, refunded, or charged back, we may reduce the related store credit balance, reverse related vault actions, or limit account access while the issue is reviewed.

8. Shipping Requests and Fulfillment

If you request shipment of cards or other products, you are responsible for providing accurate and complete shipping information. Shipment requests do not guarantee immediate fulfillment. PokéGurus may process shipments through an operational queue and may require additional confirmation, review, or verification before shipment.

PokéGurus currently ships only to addresses in the United States and Canada. We may reject, cancel, or delay shipment requests outside those countries, or any shipment request that cannot be supported by our active carrier and fulfillment setup at the time of payment or label purchase.

Shipping prices, services, insurance, and delivery estimates may be generated by shipping vendors or operational fallback logic and may change before payment is completed. Delivery times are estimates only. Once an item is transferred to the carrier, risk of loss may pass to you to the extent permitted by law and our shipment policies. We may cancel, delay, reject, split, or consolidate shipments for address quality, carrier, operational, fraud, compliance, or inventory reasons.

If a package is delayed, returned, lost, damaged, or misdelivered, we may work with the carrier and review the shipment request, but we do not guarantee a particular carrier outcome, delivery date, replacement result, or reimbursement result unless required by applicable law.

9. Pricing, Market Data, and Analytics Disclaimers

PokéGurus uses third-party and internal data sources to display prices, market trends, population information, sold listings, analytics, and card metadata, including vendors such as PriceCharting, GemRate, Pokémon Price Tracker, PSA, and Pokémon TCG image/data sources. We do not guarantee that any price, valuation, market tier, trend, population figure, grading signal, sold-comp record, metadata field, or analytics output is complete, current, accurately matched, uninterrupted, or error-free.

The platform is for informational and entertainment purposes and does not constitute financial, investment, tax, legal, grading, or professional advice. You are solely responsible for any collecting, shipping, grading, buying, selling, or redemption decisions you make.

10. Acceptable Use

You agree not to:

  • use the platform for unlawful, fraudulent, or deceptive activity;
  • attempt to manipulate pulls, odds, store credit, pricing, inventory, vault actions, or shipments;
  • probe, bypass, tamper with, or replay security, session, CSRF, seed, webhook, or payment flows;
  • use bots, scripts, credential stuffing, scraping, or automation in a way we have not expressly authorized;
  • reverse engineer, extract, harvest, or republish platform data or vendor data in a way that violates these Terms or applicable third-party rights;
  • interfere with the security, availability, or proper functioning of the platform; or
  • abuse or attempt to exploit technical issues, replay requests, or account flows.

11. Intellectual Property

The PokéGurus platform, including our software, branding, design, text, graphics, and original site content, is owned by PokéGurus or its licensors and is protected by applicable intellectual property laws. Pokemon-related names, images, and marks may belong to their respective owners. Use of third-party content does not imply ownership or affiliation.

12. Third-Party Services and Sources

We may rely on or link to third-party providers and sources, including payment processors, Google sign-in services, address validation/autocomplete tools, shipping vendors, analytics tools, image hosts, pricing services, population data providers, and other external services. We are not responsible for third-party content, terms, policies, availability, rate limits, outages, API changes, or business decisions, and your use of those services may be subject to their separate terms and privacy policies.

13. Suspension and Termination

We may suspend, restrict, or terminate your access at any time, with or without notice, if we believe you violated these Terms, created risk for the platform, or engaged in abusive, fraudulent, or unlawful conduct.

14. No Affiliation With Pokémon Rights Holders

PokéGurus is an independent platform and is not endorsed by, sponsored by, affiliated with, or officially connected to The Pokémon Company, Nintendo, Game Freak, Creatures, PSA, Beckett, CGC, SGC, PriceCharting, GemRate, Pokémon Price Tracker, eBay, Google, Stripe, Shippo, or any other third-party rights holder or service provider unless we explicitly say so. Pokémon names, images, card references, set names, logos, grading marks, and related trademarks belong to their respective owners.

15. Disclaimers

PokéGurus is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted service, secure operation, availability of any feature, or error-free results.

16. Limitation of Liability

To the fullest extent permitted by law, PokéGurus and its owners, operators, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, inventory opportunity, or shipping opportunity arising out of or related to your use of the platform.

To the fullest extent permitted by law, our total liability for any claim relating to the platform will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim or $100.

17. Indemnification

You agree to indemnify and hold harmless PokéGurus and its affiliates, operators, and service providers from claims, damages, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, or your violation of law or third-party rights.

18. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless we say otherwise. Your continued use of PokéGurus after an update means you accept the revised Terms.
